beBIONIC Website Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of online interfaces and properties (e.g., websites) owned and controlled by beBIONIC, LLC, including the www.bebionicnow.com website (the “Site”), as well as the services (“Services”) and products (“Products”) available through the Site. beBIONIC, LLC (“beBIONIC,” “we,” “us,” or “our”) is a medical spa providing clinical and aesthetic treatments through licensed professionals in Tampa, FL, with consultations offered both in-person and via telehealth. The terms “you” and “your” refer to you, your dependent(s), if any, and any other person accessing your beBIONIC account.
Please read these Terms carefully before accessing our Services. Your acceptance of, and compliance with, these Terms is a condition to your use of the Site, Services, and purchase of Products. By accessing or using the Site, you acknowledge that you have read, understand, and accept all terms and conditions contained within these Terms, our Notice of Privacy Practices, and our Privacy Policy. If you do not agree to be bound by these Terms, you are not authorized to access or use this Site or Services; promptly exit this Site.
We may amend these Terms by posting updated versions on our Site. By continuing to access or use our Services after we post amendments, you confirm your agreement to the Terms, as amended. If you do not agree with any changes, you must immediately stop accessing our Services, and your license to use our Services will terminate.
Binding Arbitration; Class Action Waiver: These Terms provide that all disputes between you and beBIONIC relating to these Terms or your use of the Site will be resolved by BINDING ARBITRATION. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT (INCLUDING IN A CLASS ACTION PROCEEDING) to assert or defend your rights under these Terms. Your rights will be determined by a NEUTRAL ARBITRATOR, not a judge or jury, and your claims cannot be brought as a class action. See Section 17 for details regarding your agreement to arbitrate disputes with beBIONIC.
1. Privacy Practices
You agree that information provided by or collected from you in connection with the Services and Site is governed by the beBIONIC Privacy Policy, available here, which complies with U.S. HIPAA regulations and is incorporated by reference into these Terms.
2. Services Provided – Medical Spa and Telehealth Services by beBIONIC
beBIONIC operates as a medical spa offering clinical and aesthetic treatments, including hormone therapy, weight management, and skin rejuvenation. Services are provided by licensed professionals (e.g., Doctors [MD/DO], Nurse Practitioners, Physician Assistants) employed or contracted by beBIONIC. Consultations are offered in-person at our Tampa, FL, facility or via telehealth using synchronous and asynchronous telecommunications technologies, in compliance with Florida telehealth laws (Florida Statutes §456.47).
Medications: Prescriptions, including brand-name or compounded medications, may be provided based on the professional judgment of our licensed professionals to support your treatment plan. Medications are prescribed solely for your personal use, and you agree to read all product information and contact a healthcare provider with any questions. Medications are sourced from LegitScript-certified or NABP-accredited pharmacies, and you have the freedom to choose your preferred pharmacy for prescription fulfillment.
No Medical Advice Without Consultation: The content on the Site, including text, images, and other materials, is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for questions regarding your health or before starting, stopping, or modifying any treatment. beBIONIC’s Services establish a provider-patient relationship only after a formal consultation, whether in-person or via telehealth.
Telehealth Services: If you choose telehealth consultations, you agree to comply with our telehealth consent form (available prior to consultation) and provide accurate medical history and contact information to ensure appropriate care. Telehealth consultations are conducted using secure platforms, but you acknowledge potential risks, including:
- Insufficient information transmission (e.g., poor image resolution) that may affect medical decision-making.
- Delays in evaluation or treatment due to equipment or connectivity failures.
- Lack of access to full medical records, which may lead to adverse drug interactions or errors.
- Potential breaches of privacy, despite HIPAA-compliant security protocols. Telehealth services are not suitable for emergencies and may not replace in-person care with your primary healthcare provider. You agree to follow provider recommendations for follow-up care.
Not for Emergencies: The Site and Services, including telehealth consultations, are not for medical emergencies. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, DIAL “911” IMMEDIATELY. Do not disregard or delay seeking medical advice based on Site content. Seek emergency help or follow-up care when recommended by a provider or as needed.
3. Regulatory Compliance
beBIONIC operates in compliance with all applicable state and federal regulations, including but not limited to:
- Licensure: All clinical services are provided by licensed professionals with active credentials, including DEA Certificates for prescribing controlled substances (e.g., testosterone, Low Dose Naltrexone).
- Prohibited Services: beBIONIC does not offer prohibited services such as steroids for bodybuilding, hCG for weight loss, stem cell/exosome therapy, or ozone therapy.
- HIPAA Compliance: We protect your personal health information in accordance with U.S. HIPAA regulations.
- Florida Medical Spa and Telehealth Regulations: beBIONIC complies with Florida laws governing medical spas and telehealth (e.g., Florida Statutes §456.47), including licensure, oversight, and telehealth practice standards.
- Non-Discrimination: beBIONIC provides services without discrimination based on race, color, national origin, age, disability, or sex, in compliance with applicable federal and state laws.
You agree to provide accurate and truthful information to ensure compliance with regulatory requirements, including Whois information for domain transparency.
4. Availability of Services
beBIONIC operates subject to state and federal regulations, and Services may not be available in all states. You represent that you are not barred from receiving Services under U.S. or applicable jurisdictional laws. Access to the Site and Services is limited to users in states where Services are available, primarily Florida. Telehealth services are subject to state-specific restrictions. Services are not available outside the United States.
5. Ordering and Purchasing of Services or Products
Order Acceptance and Shipment: Placing an order does not guarantee acceptance. We may require additional information to process your order. Once a properly completed order and payment authorization are received, we will process your order for shipment or service delivery. If we cannot fulfill your order within 30 days, we will cancel it and notify you. Orders from dealers, wholesalers, or resellers are not accepted.
Typographical Errors and Incorrect Pricing: If a Product or Service is listed at an incorrect price due to a typographical or third-party error, we may refuse or cancel orders placed at the incorrect price, even if confirmed and charged. If charged, we will promptly issue a refund.
Risk of Loss: For shipped Products, risk of loss and title pass to you upon delivery to the carrier.
Return Policy: Returns are subject to our Return Policy posted on the Site.
Online Payments: We accept major U.S. credit and debit cards. For recurring payments (e.g., memberships), charges will be billed to the designated card until you cancel at least 48 hours before the renewal date by contacting us via website or updating your account. You represent that payment information is accurate, charges will be honored, and you are authorized to make the transaction.
6. Eligibility; Site Access, Security, and Restrictions; Passwords
You must be 18 or older to access the Site and Services. You agree to create a beBIONIC account with accurate information (e.g., name, address, phone, email, password). Your account credentials are personal, and you are responsible for their confidentiality and all activities under your account. Notify beBIONIC immediately of any unauthorized use or security concerns. We may revoke access at our discretion.
You are prohibited from violating Site security, including accessing unauthorized data, probing system vulnerabilities, or using automated tools (e.g., scrapers, bots) to copy data. Violations may result in civil or criminal liability, and beBIONIC may cooperate with law enforcement.
7. Electronic Communications
By using the Site or Services, you consent to electronic communications (e.g., emails, messages) from beBIONIC. All agreements and notices may be provided electronically, satisfying legal requirements for written communication. beBIONIC may contact you to verify account information, and you agree to provide requested information within 14 days or risk suspension of access.
8. Consent to Receive Calls/SMS
By providing your phone number, you consent to receive automated and recurring calls or text messages from beBIONIC for informational and Service-related purposes (e.g., appointment reminders, prescription fulfillment, telehealth consultation updates). Opt out by texting STOP or contacting us via website. Message and data rates may apply. Withdrawing consent may limit access to certain features, including telehealth services.
9. Ownership of the Site and Related Materials; Additional Restrictions
The Site and its content are owned by beBIONIC or its licensors, protected by U.S. and international copyright and trademark laws. You are granted a revocable, nontransferable, personal, noncommercial license to use the Site. You may not reproduce, copy, sell, or exploit Site content for commercial purposes without written consent. Unauthorized use of trademarks, logos, or content is prohibited.
10. No Users Under 18 Years Old
The Site and Services are for users 18 and older. If we learn that personal information from someone under 18 has been collected, we will delete it. Contact us if you believe we have such information.
11. Accuracy of Information; Functionality
beBIONIC strives to ensure Site accuracy but makes no warranties about correctness or completeness. Errors may occur, and third parties may make unauthorized changes. Notify us of inaccuracies for correction. We may modify, suspend, or discontinue Site features at our discretion and are not responsible for transmission errors or data maintenance.
12. Links to Other Sites
beBIONIC is not responsible for third-party websites linked from the Site. Accessing such sites is at your own risk, and links do not imply endorsement.
13. User Information
You agree not to submit User Information that is false, defamatory, unlawful, or harmful, or that violates privacy or intellectual property rights. For telehealth consultations, you agree to provide accurate medical history and contact information to ensure safe and effective care. beBIONIC may de-identify and use such information for analytics or research. You are responsible for ensuring User Information is accurate and lawful.
14. Claims of Copyright Infringement
beBIONIC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). To report infringement, send a notice to our Copyright Agent:

Include the copyrighted work, infringing material, your contact information, and statements of good faith and accuracy. For counter-notices, include details of the removed material and consent to jurisdiction in Tampa, FL.
15. CAN-SPAM Act and Telephone Consumer Protection Act Compliance
beBIONIC complies with the CAN-SPAM Act and TCPA. Emails and texts, including those for telehealth services, are intended to meet these standards. Contact us if you believe communications violate these laws. You agree not to use the Site to send spam, propagate viruses, or infringe intellectual property rights.
16. Disclaimer of Warranties
beBIONIC provides the Site and Services “AS IS,” with no warranties of uninterrupted access, error-free operation, or accuracy. You assume all risks for Site use, including viruses or data loss. No guarantee is made that prescriptions will be written, and beBIONIC does not prescribe DEA-controlled substances (e.g., opioids, amphetamines). beBIONIC is not liable for consequences from Product or Service use, including telehealth consultations.
17. Dispute Resolution; Arbitration Agreement
Any dispute arising from these Terms or your use of the Site or Services, including telehealth services, will be resolved by binding arbitration under the U.S. Federal Arbitration Act, not in court. You waive the right to a jury trial or class action. Arbitration will follow the American Arbitration Association’s (AAA) Commercial Arbitration Rules, administered in Tampa, FL. If no resolution is reached within 30 days, arbitration may commence. Claims under $10,000 may be conducted via documents, phone, or in-person hearings; larger claims follow AAA Rules. Each party pays its own costs, unless statutory fee-shifting applies. If unenforceable, disputes will be resolved in state or federal courts in Hillsborough County, FL.
18. Limitation of Liability
beBIONIC is not liable for direct, indirect, or consequential damages arising from Site or Service use, including telehealth consultations, except as required by law. Your sole remedy is to stop using the Site or Services. Maximum liability is $500.
19. No Third-Party Rights
These Terms confer no rights on third parties, except as stated.
20. Assignment
You may not assign these Terms without beBIONIC’s consent. beBIONIC may freely assign or transfer these Terms.
21. Force Majeure
beBIONIC is not liable for breaches due to events beyond our control (e.g., natural disasters, pandemics).
22. Indemnification
You agree to indemnify beBIONIC and its affiliates against claims arising from your use or misuse of the Site or Services, including telehealth services, breach of these Terms, or negligent acts.
23. Revisions; General
beBIONIC may terminate your access to the Site without notice. These Terms may be revised by posting updates, effective upon posting. Review the Terms regularly. If any provision is unenforceable, others remain in effect. These Terms constitute the entire agreement between you and beBIONIC.
